Terms of Sale

It is hereby agreed by and between Healthvues (Seller) and Buyer that Buyer is purchasing certain educational DVD(s) and related materials from the Seller at the agreed price listed per product and under the following terms and conditions:

1. This Agreement does not create or establish an attorney-client relationship, or doctor-patient relationship between the Buyer and the Seller.

2. The content of any DVD and any related course materials do not constitute legal or medical advice.

3. Buyer agrees and acknowledges that Buyer will use the DVD and any related materials solely for the individual Buyer's educational purposes only.

4. Buyer agrees and acknowledges that Seller retains all copyright, ownership and property rights to the DVD, its content and any related course materials.

5. Buyer agrees and acknowledges that Buyer shall not copy, publish, duplicate, replicate, broadcast, share, distribute or sell the DVD or any related materials whatsoever.

6. Buyer agrees and acknowledges to limit Seller¹s total liability for any and all claims, disputes, demands, suit. damages, costs, attorney fees and expenses arising from or related to the purchase or use of the DVD or any related course materials to the total cost paid by the Buyer for the DVD.

7. If a dispute arises between Buyer and Seller, all disputes, claims, suits or demands by the Buyer or Seller shall be resolved through binding Arbitration according to the Rules of the American Arbitration Association. The location for all arbitration proceedings shall be the state of Nevada.

9. Seller makes no express or implied warranties or representations regarding fitness for a particular purpose, merchantability or otherwise to the Buyer.

The parties intend that the provisions of this Agreement be enforced to the fullest extent permitted by applicable law. Accordingly, the parties agree that if any provision is deemed not enforceable, the provision shall be deemed modified to the extent necessary to make it enforceable and in such manner as comes closest to the intentions of the parties to this Agreement as is possible.
